Bluebell Stalls - Terms & Conditions Apply 2023-2024

These terms and conditions (“T&C’s”) together with any documents referred through within these T&C’s and any applicable sellers T&C’s (as defined at 3.1) on which you are permitted to use our website www.bluebellstalls.com (“site“) purchase any products /services (“Products / Services”) on our site.

Please read these T&C’s carefully and make sure you fully understand them before using or ordering any products /services from our site.

Your use of www.bluebellstalls.com constitutes acceptance of these T&C’s and any of any applicable Seller. In the event of you not accepting these T&C’s or those of any applicable seller you should log off and leave the site.

IMPORTANT: Please ensure you refer to the terms and conditions of each individual seller which are shown on their own individual selling pages.

  1. About us

    1. 1 We are Bluebell Stalls a Company registered in England & Wales at our registered address Brentwood Avenue, Liverpool, L23 2UZ. We operate the site Bluebellstalls.com

  2. Availability

2.1 Whilst we endeavour to make our Site available at all times, we are not responsible for any period or periods when it is unavailable or inaccessible for whatever reason.

2.2 We reserve the right to withdraw your access to our Site at any time and for any reason with no liability whatsoever as a result of this.

2.3 We do not accept any stallholders from outside the Merseyside Uk area.

  1. Our status

3.1 We accept orders in two capabilities as an agent / promoter on behalf of third party sellers (“Sellers”) and as a service provider in our own right. Each product listed on the Site clearly specifies who is the seller of the Product.

  1. Acting as an agent

4.1 Where we act as agents / promoter on behalf of Sellers, the resulting legal contract is between yourself (“the customer”) and that seller and is subject to the T&C’s specified by that Seller. You should always carefully review the T&C’s applying to any transaction. We do not own or control any of the Products available for purchase through our site from our Sellers.

4.2 We do not review or control, and are in no way responsible for any of the listings and descriptions of products provided by our Sellers, and therefore accept no responsibility for the content thereof.

4.3 We may provide links on our Site to the websites of other companies / charities, whether they are affiliated to us or not. We cannot give any undertaking that Products you purchase from sellers throughout our site, or from companies to whose website we have provided a link to on our site will be to a satisfactory quality and any such warranties are excluded by us absolutely. This does not affect your statutory rights against any seller.

4.4 After placing your order you will be contacted by the Seller acknowledging they have received your order. Please not this does not mean your order has been accepted. Your order constitutes an offer to the Seller to buy a Product and is subject to these T&C’s and those of the applicable Seller. All orders are subject to acceptance by the Seller and they will contact you to arrange payment & delivery options.

5. Acting as a service provider

5.1 Where we act as a service provider, the resulting legal contract is between yourself and Bluebell Stalls and is subject to the T&C’s which you should carefully review.

5.2 After applying for a stall, you will receive an email from us acknowledging receipt of your application. Please not this does not mean your stall has been booked as it is subject to acceptance by us and will confirm acceptance via email including an invoice for payment

5.3 You have the right to cancel a booking at any time however we cannot issue any refund for cancelled / no show on the day stalls. We accept no further liability for any costs incurred by yourselves.

5.4 We reserve the right to cancel any event at any time and under such circumstances a full refund will be given. Beyond offering you a refund we accept no further liability for any costs incurred by yourselves.

5.5 We reserve the right to refuse any application without the need for a reason to be given.

6. Documentation

6.1 We require copies of the following documentation prior to acceptance of your stall booking & trading:-

  • Public & Product Liability Insurance

  • Food Standard Agency Rating Certificate.

  • A valid food hygiene certification with your local Environment Health Department

  • Registered Qualified Therapist Certificate(s).

  • PAT certificate / invoice for electrical items used

6.2 Failure to provide the appropriate documentation will lead to the cancellation of your booking & may incur admin charges.

7. Health & safety

We are currently reviewing our health & safety policies to meet the latest Government COVID19 requirements.

Bluebell Stalls provide a safe venue for all the people attending the fayre therefore we need to ensure that all Therapists, Stall holders & Catering Staff work with Bluebell Stalls by obeying some basic guidelines and rules.

7.1.1 All Toys & Games sold at a Bluebell’s fayre need to be C E Tested. The C E mark is a mandatory requirement which enables free movement of products sold within the European market.

7.1.2 Sellers using any electrical equipment at an event must list each item when applying for a stall to include ampage / wattage. Failure to comply with this may lead to you being unable to use at the event.

7.1.3 Sellers using any electrical equipment over 12 months old must supply a valid PAT certificate prior to use at an event. Failure to comply with this will lead to you being unable to use at the event.

7.1.4 Sellers must produce the requested documentation & have available on the day of the event (as outlined in section 6) to ensure all health & safety requirements are met . Failure to comply with this may lead to you being unable to trade at the event.

7.1.5 Health and Safety Officials under the Health & Safety at Work Act 1974 can at any time inspect the site during the event. Where appropriate, sites may also be inspected by Environmental Health, Trading standards officers or any other professional body.

7.1.6 Sellers must at all times keep designated walkways / paths clear of any stock / debris & must remove their own rubbish at the end of an event.

7.1.7 Sellers must read / accept and adhere to our COVID-19 regulations

8. Public Liability Insurance

8.1 All Sellers are responsible for the insurance of their own property and must have current Public Liability Insurance (recommended £2m-£5m coverage) at the time of applying for a stall at an event.

8.2 Bluebell Stalls accepts no responsibility for any stock theft or destruction of any exhibit, goods, property or equipment

8.3 All Sellers must be able to produce original documents on request.

9. Registration / Booking a stall

9.1 All stallholders must register with Bluebell Stalls prior to applying for a stall.

9.2 All documentation must be supplied as outlined in section 6

9.3 Registration is not confirmation of a stall as it is subject to availability

9.4 Applying for a stall is not confirmation of a stall space as it is subject to availability. Bluebell Stalls will normally respond to your registration / application within 2 working days unless in busy periods this time maybe slightly extended.

9.5 Applications by any other means will not be accepted and may lead you to missing an event.

9.6 Only goods to be sold on the booking form will be allowed to be sold on the day of the fayre. If Goods are not stated, these will be asked to be removed.

9.7 Counterfeit / dangerous items (guns / weapons / knives ect…) are prohibited from sale and if presented will be asked to be removed.

10. Price and Payment

10.1 The price of Products / services will be as quoted on this site, except in cases of obvious error.

10.2 Products / services prices are subject to change at any time, but changes will not affect orders in progress.

10.3 Payments for products / services from our Sellers will be agreed via the individual Sellers T&C’s. Bluebell Stalls accepts no responsibility / liability for these payments.

10.4 Payments for Bluebell Stalls services will be billed via invoice & payments are to be made via bank transfer 10 days prior to the event. No payments can be accepted on the day of the event.

10.5 On confirmation of a stall Sellers have a shared responsibility for promoting the event via social media & other means. Failure to comply with this may lead to future events being refused.

11. Intellectual Property

11.1 All copy-write, database rights, trade marks and other intellectual property rights whether registered or unregistered are wither owned by or licensed to Bluebell Stalls.

11.1 You must not use any part of the materials on our site for commercial purposes without obtaining a license to do so at Bluebell Stalls.

12. Misuse of our Site

12.1 You must not misuse or interfere with the workings of our site by knowingly introducing viruses, Trojans, worms or any other harmful programmes or materials.

12.2 You must not attempt to gain unauthorised access to our site or otherwise disrupt our Site or the server our Site is stored on or any server, computer or database connected to our site.

13. Liability

13.1 Whilst we take great care to ensure that out Site is accurate & up to date at all times, we are unable to guarantee the site will be error free or that our Site or the servers that make it available are free from viruses or bug, therefore we accept no liability in the regard.

13.2 We do not accept any liability for any delays, failures, errors or omissios or loss of transmitted information, viruses or other contamination or destructive properties transmitted to you or your computer system via our Site.

13.3 Whilst we have taken reasonable steps to prevent internet fraud and ensure any data collected from you is stored as securely and safely as possible, we cannot be held liable in the extremely unlikely event of a breach in our secure computer servers or those of third parties.

13.4 Nothing in these T&C’s exclude or limits our liability for fraud or fraudulent misrepresentation or any other matter for which it would be illegal for us to exclude or attempt to exclude our liability.

13.5 When purchasing any product / service from a Seller the Sellers individual liability will be set out in their own T&C’S and we make no warranty as the the quality / safety of any of our Sellers Products / services (including but not limited to) any products which are or could be construed as a toy or its suitability or fitness for purpose.

13.6 Personalised items are also subject to the individual Sellers T&C’s and we would always advise on checking order details of any personalised items. Bluebell Stall accepts no liability in this matter.

13.7 We do not accept any liability for any loss which is not direct and reasonably foreseeable, however arising and even if we have previously been advised of the possibility of such loss.

13.8 We may provide links on our Site to other companies, whether they are affiliated to us or not. We cannot give any undertaking that Products you purchase from Sellers through our site, or from other companies to whose website we have provided a link om our site will be of satisfactory quality, and any such warranties are excluded by us absolutely. This does not affect your statutory rights against any Seller or us.

14. GDPR

Your personal data is in Safe hands with Bluebell Stalls

14.1 Bluebell Stalls aims to ensure that all personal data collected from Stallholders, Customers, Hirers, Volunteers & Visitors is collected, stored and processed in accordance with the general Data protection Regulation (GDPR). This Policy applies to all personal data, regardless of whether it is in paper or electronic format.

14.2 Bluebell Stalls will not sell any of your personal data to third parties

14.3 We’ll always go the extra mile to protect your personal data and as part of this, we regularly review our privacy notices. Please be aware that further changes relating to GDPR may be made to our Terms & Conditions in the future as this new regulation evolves.

15. Advertising

15.1 Sellers / Charities / Hirers have a shared responsibility for promoting each Bluebell Stalls event they are involved in.

15.2 There is an opportunity for Sellers to advertise their business on out Site for a nominal annual fee (paid yearly in advance)

16. Waiver

16.1 If we fail to exercise any of the rights or remedies to which we are entitled under these T&C’s or to insist on your performance of any obligations placed on you under these T&C’s or any other document referred to in them, this will not constitute a waiver of such rights or remedies and will not relieve you from compliance with such obligations.

16.2 A waiver by us of any default will not constitute a waiver of any subsequent default.

16.3 No waiver by us of any of these T&C’s will be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

17. General

17.1 Any times specified on this Site are working days unless otherwise stated.

17.2 If any court or competent authority decides that any of the provisions in these T&C’s are invalid, unlawful or unenforceable to any extent, the term will to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

17.3 These T&C’s and any document referred to them constitute the whole agreement between us and supersede all previous discussions, correspondence, previous arrangement, understanding or agreement between us.

17.4 These T&C’s and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law.

17.5 We reserve the right to revise and amend these T&C’s from time to time and you should therefore review these T&C’s from time to time.
